Apple not giving up on Samsung patent battle

Apple is requesting to ban Samsung devices that “infringe” on its patents, but also requested a total retrial of the case at the U.S. district court in San Jose.

Apple filed a sales ban request in the US District Court for nine older Samsung devices, including the Galaxy Nexus, Galaxy S3, Galaxy Note 2 and others. While the request may be merely administrative in context of the devices’ ages, Apple will likely continue on this route until it decides that Samsung has been, if not hurt, then significantly embarrassed, for its transgressions.

In March, it was reported that Apple sought about $2 billion in damages from Samsung for selling handsets and tablet devices that Apple claimed violated five of its mobile software patents. Samsung then fired back that Apple had violated two of its patents.

During the trial Apple had accused Samsung of “systematically” copying features distinctive to its iOS software. Samsung denied that it had copied Apple patents and said it was Apple who was doing the copying.

The jury found that Apple had infringed some Samsung patents and awarded $158,000 in damages to the South Korean firm.

Two years ago, a separate jury ordered Samsung to pay Apple $930m after finding it had used Apple technology. That verdict is still being challenged by Samsung.
